By creating an account, viewing videos, making a purchase, downloading our software, or otherwise visiting or using our services, you accept this Agreement and consent to contract with us electronically.
If you are an entity other than a natural person, the person who registers the account or otherwise uses our services must have the authority to bind the entity. In this context, "you" means both the entity and each person who is authorized to access the account.
We may update this Agreement by posting a revised version on our website. By continuing to use our services, you accept any revised Agreement.

We are constantly improving our services. We may add or remove functionalities or features, and we may suspend or stop a service altogether.
You can stop using our services at any time. HowLive may also stop providing services to you or add or create new limits to our services at any time.
We believe that you own your data and preserving your access to such data is important. If we discontinue a service, where reasonably possible, we will give you reasonable advance notice and a chance to get information out of that service.
OTHER THAN AS EXPRESSLY SET OUT IN THESE TERMS OR ADDITIONAL TERMS, NEITHER HOWLIVE NOR ITS SUPPLIERS OR DISTRIBUTORS MAKE ANY SPECIFIC PROMISES ABOUT THE SERVICES. FOR EXAMPLE, WE DON’T MAKE ANY COMMITMENTS ABOUT THE CONTENT WITHIN THE SERVICES, THE SPECIFIC FUNCTIONS OF THE SERVICES, OR THEIR RELIABILITY, AVAILABILITY, OR ABILITY TO MEET YOUR NEEDS. WE PROVIDE THE SERVICES “AS IS”.
SOME JURISDICTIONS PROVIDE FOR CERTAIN WARRANTIES, LIKE THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. TO THE EXTENT PERMITTED BY LAW, WE EXCLUDE ALL WARRANTIES.
WHEN PERMITTED BY LAW, HOWLIVE, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE RESPONSIBLE FOR LOST PROFITS, REVENUES, OR DATA, FINANCIAL LOSSES OR INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES.
TO THE EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF HOWLIVE, AND ITS SUPPLIERS AND DISTRIBUTORS, FOR ANY CLAIMS UNDER THESE TERMS, INCLUDING FOR ANY IMPLIED WARRANTIES, IS LIMITED TO THE AMOUNT YOU PAID US TO USE THE SERVICES (OR, IF WE CHOOSE, TO SUPPLYING YOU THE SERVICES AGAIN).
IN ALL CASES, HOWLIVE, AND ITS SUPPLIERS AND DISTRIBUTORS, WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.
We may modify these terms or any additional terms that apply to a service. You should look at the terms regularly. Changes will not apply retroactively and will become effective no sooner than fourteen days after they are posted. However, changes addressing new functions for a service or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for a service, you should discontinue your use of that service.
If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict.
These terms control the relationship between HowLive and you. They do not create any third-party beneficiary rights.
If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up or waiving any rights that we may have (such as taking action in the future).
HowLive and you are independent contractors of one another; neither party is an agent, partner, or joint venturer of the other. This Agreement binds the parties and their successors, personal representatives, and assigns. You may not assign this Agreement to any person, any such assignment will be void.
If it turns out that a particular term is not enforceable, this will not affect any other terms.
The laws of California, U.S.A., excluding California’s conflict of laws rules, will apply to any disputes arising out of or relating to these terms or the services. All claims arising out of or relating to these terms or the services will be litigated exclusively in the federal or state courts of Santa Clara County, California, USA, and you and HowLive consent to personal jurisdiction in those courts.
This Agreement constitutes the entire understanding of the parties and supersedes all prior understandings regarding the subject matter hereof and may not be modified except by a document executed by authorized representatives of HowLive.

We collect your personal data and other information when you make purchases, use or register into our products and services, including typical web server logs, IP address, geographic area and similar data. In addition, we maintain records of user interactions on the page, tied to a unique session-id. These are collected for usage statistics purposes. The session id is not linkable to personal data. These interaction logs do not contain user-specific details.
We maintain records of the details of merch purchases in the server log for the purpose of troubleshooting any shipping problems. These logs may contain the shipping information, e.g. purchasers name, delivery address and email (if entered). Purchase log does not contain any credit card information. Credit card data never goes through our servers.
In order for HOWLiVE to provide you with our services, we work with third parties with whom we may share personal data necessary to support these services.
HOWLiVE remains responsible for the processing of personal data carried out by third party service providers that HOWLiVE has engaged with for respective data processing in accordance with applicable laws.
In certain circumstances, we may also be required to share information with third parties to conform to legal requirements or to respond to lawful requests by public authorities as well as to protect our, or a third party’s, lawful interests.
We may retain your personal data for as long as your relationship with us is active by having a HOWLiVE account, or as otherwise needed to provide you our Services.
After terminating your relationship with us by deleting your HOWLiVE account or otherwise ceasing to use our Services, we may continue to store copies of your personal data as reasonably necessary to comply with our legal obligations to prevent fraud and abuse, to enforce our agreements, and/or to protect our legitimate interests.
If you are located in the European Economic Area, in accordance with European Union data protection regulations, you have certain rights with respect to your personal data.
You have the right to request access to your personal data and to correct, amend, delete or limit the use of your personal data by logging into your HOWLiVE account or by reaching us using the contact information provided below. Furthermore, if you believe that we have unlawfully processed your personal data, you have the right to submit a complaint to the contact information provided below, or to your respective data protection supervisory authority.
We seek to use reasonable organizational, technical, and administrative measures to protect the confidentiality, integrity, and availability of personal data. Unfortunately, no data transmission or storage system is guaranteed to be 100% secure, therefore we cannot guarantee absolute security of information. We encourage you to take care of the personal data in your possession that you process online and set strong passwords for your HOWLiVE account, limit access of your computer and browser by signing off after you have finished your session and avoid providing us with any sensitive information whose disclosure you believe could cause you substantial harm.
All of HOWLiVE’s authorized personnel involved in the processing of your personal data have committed themselves to confidentiality obligations and shall not access or otherwise process your personal data without your authorization if it's not for the purposes of providing you our Services.
In the event that we experience a personal data breach, we will notify you in compliance with the obligations set out in applicable laws.
